Business Terms

1. General Terms and Conditions
The present conditions of sale and delivery are legally binding for all business relations, sales and other legal transactions between Save Our Sounds and the customers. Differing arrangements, such as telephonic or oral arrangements are only legally binding when they are confirmed in writing / e-mail by us. Orders are considered to be accepted with our written order confirmation (via e-mail) or with the delivery at the latest. Technical improvements as well as other reasonable changes and variations for the customers of portrayed models in catalogues or brochures and technical details are reserved to Save Our Sounds.

2. Prices
Relevant prices are prices indicated at the day of delivery. Our prices are calculated in EURO, including the valid VAT of the day of delivery. (19%) It is reserved to us to price our products with recommended retail prices. Arising delivery expenses can be overviewed under the categories shipping costs or order form.

3. Delivery and transfer of perils
We deliver our products with conveyances such as the Deutsche Post and DHL to the customers domicile or business location. We generally don’t do partial deliveries. Partial deliveries are only made if explicitly desired by the customer. Every order is being checked up on discrepancies. We will report every obvious attempt of deception (e. g. wrong name specified) to the police.

4. Reservation of proprietary rights
The delivered goods remain our property till complete payment of all debts belonging to us or our subsidiary companies from the business relationship with the customer. The disposal of goods that are under reservation of proprietary rights is only allowed to the customer in regular business connections. In particular – our goods are not allowed to be pawned. A cession by security is also being excluded.

5. Deficiencies
Recognizable deficiencies must be reported to us immediately. Unknowable deficiencies have to be announced directly to us in writing within the legal period of warranty. Without prejudice of any negotiations about complaints we reserve the objection of non punctual or non correct notice of defect.
Defective or wrong delivered goods are not to send back without our briefing (via e-mail). Do not forget to include a copy of the invoice. Returns without prior consultation will be disregarded by us. We point out, that we only repay shipment costs to a common (usual) extend (avoiding of high shipment costs). Non prepaid packets are being rejected by Save Our Sounds.

6. Right of revocation

6a. Right of revocation
You have the right to revoke this contract within 14 days. No specific reason has to be given. The 14 days start from the day that the customer or a third party other than the carrier and indicated by the customer acquires physical possession of the goods. Please include all details of your decision to revoke this contract by sending us an unequivocal declaration (e.g. by letter sent by post or by E-Mail).
You can also use this Sample Revocation Form, which is not obligatory however. Should the customer opt for the electronic form, we will issue a confirmation of withdrawal via E-Mail. To comply with the revocation period it is sufficient to send off the notification of exercise of your revocation right before the end of the revocation period.

6b. Effects of revocation
If the customer withdraws from this contract, we shall reimburse all payments received, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about the decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as the customer used for the initial transaction, unless we have expressly agreed otherwise; in any event, the customer will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or the customer has supplied evidence of having sent back the goods, whichever is the earliest.

The customer has to return the goods to us within 14 days starting from the day he has informed us of the revocation from the contract to the following address Save Our Sounds, Muehle 230, D-06785 Oranienbaum-Woerlitz, Germany. The deadline shall be met if the customer sends back the goods before the period of 14 days has expired. Customers returning goods generally bear the direct cost of a return.The customer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

7. Warranty
It is regulated by law that the warranty period is 24 month. Complains a customer later than 6 month after purchase reverses the burden of proof. Now the customer has to prove, that the device has had a defect when it was handled over! Save Our Sounds doesn’t give warranties in the original sense of rights. Producer warranties remain untouched of course.

8. Supplementary provisions
Rights of customers resulting from transactions with us are not allowed to be ceded. The ineffectiveness of sales terms and delivery conditions does not affect the effectiveness of the remaining conditions. Ineffective provisions are being substituted by effective provisions that come as near to the target commercial purpose as possible. Place of fulfilment for all commitments out of contractual relationships is Parchim. We exclusively acknowledge the rights of the Federal Republic of Germany. The place of general jurisdiction for all disagreements out of contractual relationships is of our own choice Dessau or any other court having the jurisdiction for the customer.

9. General advice for your order
You will find information about each arising shipment costs under the category shipment costs or in the order form. At the moment we accept the following payment methods: Prepayment via bank-transfer and Prepayment via Paypal. Other payment methods are not offered by Save Our Sounds.

10. Salvatoric clause
If there are single provisions in this general terms and conditions which are totally or partially not legally effective or for any reason lose their legal effectiveness, validity of these general terms and conditions is not effected in any way. Legally uneffective provisions are replaced by statutory provisions. The same applies for issues not mentioned in these terms and conditions or not fully covered by the description in these general terms and conditions.
